SMS marketing has stricter legal requirements than email in most jurisdictions. The core rules apply in almost every market:

Explicit opt-in: Recipients must actively consent to receive marketing SMS. Pre-checked checkboxes and implied consent are not sufficient in most countries. The consent must be specific to SMS marketing (not bundled with email consent).
Clear opt-out mechanism: Every marketing SMS must include an opt-out instruction (e.g. 'Reply STOP to unsubscribe'). Your system must honor STOP replies immediately — no re-sending to opted-out numbers.
Identification: The message must make clear who is sending it — your brand name, either in the sender ID or the message body.
Sending hours: Most jurisdictions prohibit sending marketing messages outside business hours (typically 8 AM – 9 PM in the recipient's time zone). Check local rules for your target markets.
Record keeping: Keep records of opt-in consent (date, method, IP if digital) in case of a regulatory complaint. GDPR (EU) requires this for at least 3 years.
